Terms of Service

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Atlantiq Stock offers different account types:

• Customer Accounts: For purchasing and licensing images
• Contributor Accounts: For uploading and selling images (invitation only)
• Administrator Accounts: For platform management

You may terminate your account at any time by contacting us at info@atlantiqstock.com. We reserve the right to suspend or terminate accounts that violate these Terms.

Contributor accounts are invitation-only. Atlantiq Stock reserves the right to accept or reject any contributor application at our sole discretion.

As a Contributor, you may upload Content to the Platform. You represent and warrant that:

• You own or have the legal right to upload and license the Content
• Your Content does not infringe on any third-party rights (copyright, trademark, privacy, publicity, or other rights)
• Your Content does not contain illegal, defamatory, obscene, or offensive material
• You have obtained all necessary releases for recognizable people, private property, or trademarked items in your Content
• Your Content complies with all applicable laws and regulations

Contributors retain full copyright ownership of their uploaded Content. By uploading Content, you grant Atlantiq Stock a non-exclusive, worldwide, royalty-free license to:

• Display, reproduce, and distribute your Content on the Platform
• Use your Content for marketing and promotional purposes
• Process and optimize your Content for platform performance

All uploaded Content is subject to review and approval by Atlantiq Stock. We reserve the right to reject or remove any Content that does not meet our quality standards or violates these Terms.

Contributors set their own prices for their Content. Atlantiq Stock does not control or dictate pricing.

Contributors receive 70% of the sale price for each licensed image. Atlantiq Stock retains 30% as a platform fee. This split is calculated before any payment processing fees.

• Payouts are processed monthly via bank transfer
• Minimum payout threshold: $25.00 USD
• Contributors must provide valid bank account information
• Payouts are typically processed within the first 5 business days of each month
• Contributors are responsible for any taxes on their earnings

Contributors may not upload Content that:

• Infringes on intellectual property rights
• Contains recognizable people without proper model releases
• Contains private property or trademarks without property releases
• Depicts illegal activities or encourages harm
• Contains hate speech, violence, or discriminatory content
• Contains explicit sexual content or pornography
• Violates any applicable laws or regulations

Atlantiq Stock reserves the right to remove any Content at any time for any reason, including but not limited to quality concerns, policy violations, or legal issues.

When you purchase a license to Content, you receive a non-exclusive, non-transferable, worldwide license to use the Content as specified in these Terms.

Licensed Content may be used for:

• Commercial projects (advertisements, marketing materials, websites, social media)
• Editorial projects (blogs, news articles, publications)
• Personal projects (presentations, portfolios)
• Digital and print media
• Products for resale (merchandise, prints) where the image is incorporated into a larger work

You may NOT:

• Resell, redistribute, or sublicense the Content as-is or in a stock photo collection
• Use Content in a manner that suggests endorsement of products or services without permission
• Use Content in pornographic, defamatory, or unlawful contexts
• Use Content as a trademark, service mark, or logo
• Claim authorship or ownership of the Content
• Use Content in ways that compete with Atlantiq Stock
• Register or attempt to claim copyright or trademark rights in the Content

Licenses are perpetual. Once purchased, you may use the Content indefinitely in accordance with these Terms.

A single license allows unlimited uses in multiple projects, subject to the Permitted Uses restrictions.

Attribution to the photographer is appreciated but not required unless specified in the Content description.

All prices are listed in BMD (Bermuda Dollars) unless otherwise stated. Prices are subject to change without notice.

Payments are processed securely through our payment processor (Authorize.net). By making a purchase, you agree to the payment processor's terms and conditions.

All sales are final. Due to the nature of digital products, we do not offer refunds once a license has been purchased and the Content has been downloaded or accessed.

If a payment fails or is declined, your access to the Content will not be granted. You are responsible for resolving payment issues with your financial institution.

Prices do not include applicable taxes. You are responsible for all sales, use, and other taxes associated with your purchase.

The Atlantiq Stock platform, including its design, features, functionality, and content (excluding user-uploaded Content), is owned by Atlantiq Stock and protected by copyright, trademark, and other intellectual property laws.

"Atlantiq Stock" and related logos are trademarks of Atlantiq Stock. You may not use these trademarks without our prior written permission.

Contributors retain copyright ownership of their uploaded Content, subject to the license granted to Atlantiq Stock in Section 5.3.

Atlantiq Stock respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

If you believe Content on our Platform infringes your copyright, please contact us at info@atlantiqstock.com with:

• Description of the copyrighted work
• URL or location of the allegedly infringing Content
• Your contact information
• A statement of good faith belief that use is unauthorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

If your Content is removed due to a copyright claim, you may submit a counter-notice if you believe the removal was in error.

Atlantiq Stock will terminate accounts of repeat copyright infringers.

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that Content is accurate, complete, or error-free. Contributors are responsible for the accuracy of their Content descriptions.

We do not guarantee uninterrupted or error-free operation of the Platform. The Platform may be unavailable due to maintenance, updates, or technical issues.

The Platform may integrate with third-party services (payment processors, cloud storage). We are not responsible for the performance or policies of these third parties.

These Terms shall be governed by and construed in accordance with the laws of Bermuda, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.

Before initiating arbitration, you agree to first contact us at info@atlantiqstock.com to attempt to resolve the dispute informally.

You may terminate your account at any time by contacting info@atlantiqstock.com.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, upload prohibited Content, fail to pay amounts owed, or engage in conduct harmful to the Platform or other users.

Upon termination:

• Your access to the Platform will cease
• Licensed Content previously purchased remains valid under the license terms
• Contributor earnings below the payout threshold may be forfeited
• We may delete your account data in accordance with our Privacy Policy

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Atlantiq Stock.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

These Terms do not create any third-party beneficiary rights.

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
